Litigation Procedures for Resolving Land & Property Disputes in Court

“Mandatory mediation at commune People's Committees under Land Law 2024, lawsuit preparation at competent courts, boundary surveying, and court costs.”

Standard Procedural Steps to Secure and Protect Disputed Land Rights

Boundary conflicts, handwritten purchase disputes, and reclaiming lent land require meticulous procedural compliance to avoid lawsuit dismissal.

1. Mandatory Pre-Litigation Mediation at Commune People's Committees

Under Article 235 of Land Law 2024, land disputes must undergo mandatory mediation at the commune-level People's Committee where the land is located. An unsuccessful mediation record is an indispensable prerequisite for filing a lawsuit in Court.

2. Court Jurisdiction and Lawsuit Dossier

The District/City People's Court where the real property is located holds statutory jurisdiction. Dossier includes:

  • Lawsuit petition following Form 23-DS of the Supreme People's Court.
  • Land Use Rights Certificate or papers prescribed under Article 137 of Land Law 2024.
  • Unsuccessful mediation minutes issued by the commune People's Committee.
  • Boundary records, cadastral maps, transaction agreements, and identity documents.

3. On-Site Inspection, Surveying, and Valuation

The Court orders on-site appraisal and establishes an asset valuation council. Parties must coordinate with the Land Registration Office to survey the exact current status of overlapping land parcels.
